On March 4, 2026, the Shaykhantakhur Inter-district Civil Court of Tashkent City issued a decision on the claim of the management company CMWP Uzbekistan (legal entity name LLC "CWP MC") against the apartment owner in the multifunctional complex "Nest One" for debt recovery, as well as on the counterclaim of the property owner to invalidate the minutes of the general meeting. The court concluded that it was necessary to partially satisfy the claims of both parties.
According to the case materials, the management company demanded to recover the debt from the owner for mandatory payments for the maintenance of common property. The plaintiff (Management Company CMWP Uzbekistan) substantiated its claims with a contract concluded with the developer in July 2024, according to which the company undertook obligations for the management and maintenance of the complex's apartment buildings. The defendant (apartment owner) filed a counterclaim to invalidate the minutes of the general meeting of December 2024, which included the issue of choosing a method of building management and a management company.
The court agreed with the arguments of both parties that at the meeting in December 2024, the number of voting participants (92 out of 807) did not provide the legally required quorum for decision-making, and declared the minutes invalid.
At the same time, the court granted the management company's claim for debt recovery from the homeowner for mandatory payments, stating that the absence of a direct contract between the owner and the management organization or refusal to use services does not exempt the owner from the obligation to bear the costs of maintaining common property. The court clarified that for the first two years of the building's operation, until the owners make a different decision, the right to manage and the right to determine the scope of services and the amount of contributions for the maintenance of common property are vested in the developer, who has the right to engage a management company for this purpose.
Representatives of the Ministry of Construction and Housing and Communal Services of the Republic of Uzbekistan were involved in the case and confirmed to the court that the management company was appointed in accordance with the legislation based on an agreement with the developer and is officially registered in the state billing system "Mening uyim." The developer must notify individuals wishing to purchase housing in an apartment building about the chosen management method and ensure the conclusion of an agreement with the management organization simultaneously with the housing sale agreement.
According to the director of the management company CMWP Uzbekistan, Evgeny Grikhanov, they are satisfied with the court's decision because: "This decision benefits the other owners who pay mandatory payments for the maintenance of common property."
The Director of the Management Company, Evgeny Grikhanov, explained that the company works in the interests of the owners and ensures the service and operation of a residential complex unique for Tashkent. The company's activities are completely transparent; during the court hearings, the company provided all documents regarding expenses and the justification of tariffs.
